Terms and conditions of sale

General terms of sale of Girasoli Fabio for purchases on oliocarpediem.it. Drawn up on 22 April 2025.

Art. 1 - General provisions

By browsing this area, the user accesses GIRASOLI FABIO, available at the URL https://www.oliocarpediem.it/. Browsing the site and transmitting a purchase order imply acceptance of the Conditions and of the Data Protection Policies adopted by the site and set out therein.

These General Terms of Sale apply to the sale of products solely with reference to purchases made on the site, in accordance with Part III, Title III, Chapter I of the Consumer Code (Legislative Decree no. 206/05, as amended by Legislative Decree no. 21/14 and Legislative Decree 70/03), by:

Before accessing the products provided by the site, the user is required to read these General Terms of Sale, which are deemed accepted at the moment of purchase.

The user is invited to download and print a copy of the order form and of these General Terms of Sale, the terms of which GIRASOLI FABIO reserves the right to amend unilaterally and without notice.

The website, and therefore the products it provides, may be used in the following languages: Italian and English.

Art. 2 - Subject matter

These General Terms of Sale govern the offer, the submission and the acceptance of purchase orders for products on https://www.oliocarpediem.it/.

They do not govern the supply of services, or the sale of products by parties other than the seller who are present on the site through links or banners.

Art. 3 - Conclusion of the contract

To conclude the purchase contract, the electronic form must be completed and transmitted by following the instructions.

The form contains: a reference to the terms of sale, images of the products, prices, means of payment, methods and costs of delivery, the right of withdrawal, and the method and timing of returns.

Before the contract is concluded, confirmation will be requested that the General Terms of Sale, the notice on the right of withdrawal and the data processing information have been read.

The contract is deemed concluded when the seller receives the completed form, after the data have been checked.

Payment is due from the moment the order procedure is completed, by clicking “Buy”.

The seller will take the order in hand for fulfilment.

Art. 4 - Registered users

At the time of registration, the user undertakes to provide personal data that are correct and truthful.

After registration, the user will receive a confirmation email. If it is not confirmed within 48 hours, the site will be released from any obligation.

Confirmation releases the site from any liability regarding the data. The user must communicate every change.

If the data are incorrect or are disputed, the site may suspend the service until the matter is resolved.

When the profile is activated for the first time, a username and password will be assigned.

The user undertakes to keep those details with care and not to pass them on to third parties.

Art. 5 - Availability of the products

The availability indicated is to be considered indicative, because other users may complete purchases at the same time.

If a product is unavailable after the order has been confirmed, the user will be informed by email.

If cancellation is requested, the site will issue a refund within 30 days of the request.

Art. 7 - Payment methods and prices

The price is the one shown on the site, save for obvious errors.

In the event of an error, the buyer will be notified and may confirm or cancel the order. The site is not obliged to sell at an incorrect price.

Prices may change. Changes do not apply to orders that have already been confirmed.

Purchase procedure: add the products to the cart and follow the steps indicated. The order may be changed before payment.

Accepted payment methods: credit cards, PayPal.

Art. 8 - Delivery

https://www.oliocarpediem.it/ ships throughout Italian territory, excluding Vatican City and the Republic of San Marino.

The site will make deliveries only to the user's home address provided at the time of purchase.

Within Italian territory, delivery generally takes place within one week or, if no date is specified, within the time estimated at the moment of selection, and in any case within 30 days of confirmation of the order.

For countries of the European Union: delivery in about one week, and in any case no later than 30 days.

For countries outside the EU: approximate delivery times of 4 weeks.

If delivery is not possible, the order will be held and the user will be informed so that a new delivery can be agreed.

If the user is not present at the agreed time, they may request a new delivery.

If delivery cannot be carried out, for reasons not attributable to the seller, within 30 days of the goods being available, the contract shall be deemed terminated.

In that case the amount paid will be returned, including ordinary delivery charges (and not any additional costs chosen by the user), within 30 days of termination. Any additional costs will be borne by the user.

Shipping costs, which are borne by the buyer, will be clearly indicated at the time of the order.

Art. 9 - Passing of risk

The risks relating to the products pass to the buyer at the moment of delivery. Ownership is transferred after payment in full, including shipping costs, or at the moment of delivery if delivery takes place afterwards.

Art. 10 - Warranty and commercial conformity

The seller is liable for defects and for any lack of conformity of the products in accordance with Italian law.

For consumers (natural persons who purchase for purposes outside their trade or profession), the warranty is valid within 24 months of delivery, provided that the complaint is submitted within 2 months of discovering the defect and that the online return form is completed.

In the event of lack of conformity, the consumer is entitled to repair or replacement free of charge, or to a price reduction or to termination of the contract with a refund.

All costs of returning defective products are borne by the seller.

Art. 11 - Withdrawal

The buyer may withdraw within 14 days of receiving the products, without penalty and without giving any reason (Article 57 of Legislative Decree 206/2005).

For multiple purchases delivered separately, the period runs from receipt of the last product.

To exercise the right of withdrawal, the user must send an explicit statement (which may be the model form in Annex I, Part B, of Legislative Decree 21/2014, and is optional) to:

The products must be returned intact, in the original packaging and complete with the fiscal documentation. Once conformity has been verified, the refund will be issued within 7 days (excluding shipping costs incurred by the user).

The costs of return are borne by the buyer.

The seller may withhold the refund until the goods have been received, or until the buyer provides proof that they have been shipped (Article 56, paragraph 3, of Legislative Decree 206/2005).

The right of withdrawal does not apply to the goods listed in Article 59 of Legislative Decree 206/2005.

The refund will be made using the same method of payment; in the case of a bank transfer, the user must provide the IBAN/SWIFT/BIC.

Art. 12 - Severability clause

The nullity of one clause does not affect the validity of the other provisions of the contract.

Art. 14 - Applicable law and jurisdiction

The terms are governed by Italian law, without prejudice to any mandatory provision of the country in which the buyer resides.

Disputes fall within the exclusive jurisdiction of the Italian courts; if the user is a consumer, the competent court is that of their domicile or residence.
